2. Acceptance of Terms
By accessing or using the Website, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Website or submit an enquiry through it.
To engage our Services, you must be at least 18 years of age and have the legal capacity to enter into binding agreements under Malaysian law. If you are acting on behalf of another person, you confirm that you have their authority to do so.
Submitting an enquiry form does not itself constitute the formation of a solicitor-client relationship. A formal relationship is established only upon the signing of an engagement letter.
3. Description of Services
Sinaran Legal provides legal advisory and representational services in the area of Malaysian pension and employment law. Our three principal service offerings are:
- Pension Enquiry Visit (RM 490) — an initial consultation in which we review the documents you have to hand and provide a brief written summary of how your situation appears under the relevant law.
- Records Examination (RM 1,170) — a detailed review of contribution records, employment statements, and benefit-determination letters, with written identification of points that may warrant further enquiry.
- Long-form Resolution Programme (RM 1,910) — a full legal engagement covering written representations, formal complaints, mediation, and tribunal proceedings where required.
Services are provided primarily to clients located in Malaysia. We may, at our discretion, advise clients with matters governed by Malaysian law who are located abroad, but we make no representation that our services are appropriate for or available in other jurisdictions.
4. User Responsibilities
When using the Website, you agree to:
- Provide accurate and complete information in any enquiry or communication.
- Use the Website only for lawful purposes and in accordance with these Terms.
- Not attempt to gain unauthorised access to any part of the Website or its underlying systems.
- Not submit content that is misleading, defamatory, or otherwise harmful.
- Not use automated tools to scrape, copy, or index the Website's content without our prior written consent.
5. Intellectual Property
All Content on this Website — including text, layout, and design — is the property of Sinaran Legal or its licensors and is protected under Malaysian intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to view and print pages for your own personal, non-commercial use.
You may not reproduce, republish, or redistribute any part of this Website's Content without our express written permission.
6. Payment Terms
Fees for Services are quoted in Malaysian Ringgit (RM) and are inclusive of GST where applicable. Payment terms, accepted methods, and invoicing arrangements will be set out in the engagement letter specific to your matter.
Fees paid for a Pension Enquiry Visit are not refundable once the visit has taken place and the written summary has been delivered. For the Records Examination and Long-form Resolution Programme, any refund or variation in fees will be governed by the terms of the individual engagement letter.
Sinaran Legal reserves the right to revise its fees from time to time. Current fees will always be displayed on this Website before any engagement is formalised.
7. Confidentiality
We treat all information shared with us in the course of enquiries and engagements as confidential. Details of your matter will not be disclosed to third parties except where required by law, where necessary to carry out your instructions, or with your prior consent.
Please note that information submitted via the Website's contact form before a formal engagement is established is handled with the same professional discretion, but does not attract the full legal protection of solicitor-client privilege until a written engagement is in place.
8. Disclaimers
The Content on this Website is provided for general informational purposes only and does not constitute legal advice. Reading the Website does not create a solicitor-client relationship.
While we take care to keep information current and accurate, the law changes, and we cannot warrant that every page reflects the most recent legal position. You should not act on anything you read here without first taking specific professional advice from us or another qualified practitioner.
The Website is provided on an "as is" basis. We do not warrant uninterrupted or error-free access, and we may modify or withdraw pages at any time without notice.
9. Limitation of Liability
To the extent permitted by Malaysian law, Sinaran Legal's liability for any claim arising from use of the Website (as distinct from a formal engagement) is limited to direct losses only. We exclude liability for indirect, consequential, or economic losses arising from reliance on Website Content.
Nothing in these Terms limits our liability for death or personal injury arising from our negligence, or for any matter that cannot lawfully be excluded.
Our liability in respect of any formal Service engagement is governed by the terms of the applicable engagement letter.
10. Indemnification
You agree to indemnify and hold harmless Sinaran Legal, its partners, and its staff from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these Terms or your unlawful use of the Website.
11. Termination
We may suspend or restrict access to the Website at any time, for any reason, without notice. Where a formal engagement has been established, termination of that engagement is governed by the engagement letter and the applicable rules of the Bar Council Malaysia.
Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, and Limitation of Liability — will remain in effect.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms shall first be referred to informal discussion between the parties. If a resolution cannot be reached within 30 days, the matter shall be submitted to mediation under the auspices of the Malaysian Mediation Centre before any court proceedings are commenced.
The courts of Malaysia shall have exclusive jurisdiction over any dispute that proceeds to litigation.
13. General Provisions
- Entire Agreement: These Terms, together with any engagement letter, constitute the whole agreement between you and Sinaran Legal in respect of the subject matter herein.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to exercise any right under these Terms does not constitute a waiver of that right.
- Assignment: You may not assign any rights or obligations under these Terms without our prior written consent.
- Notices: Formal notices to Sinaran Legal should be sent to the address or email below.
14. Changes to These Terms
We may revise these Terms at any time by updating this page. The date at the top of this page will reflect the most recent revision. Continued use of the Website after an update constitutes acceptance of the revised Terms. We encourage you to check this page periodically.
